Clamping Issue

Today a freind was clamped by the DVLA they are insisting he pays for its release the car is on privatley owned land to which the owners have not given consent for the DVLA to clamp untaxed vehicles. The vehicle is SORN and Immobolised.
Do we let them take the car and safe store it, whilst sueing their butts
or remove clamp and move car or just chain the car to another vehicle, their for preventing them taking it and write to them, as telephone conversations has resulted in DVLA hanging up.
